1. Agreement to these terms
These Terms of Service (“Terms”) govern your access to and use of the website melbournemovepro.online and any professional business and consulting services supplied by Melbourne Move Pro Pty Ltd (ABN 88 703 636 631) (“we”, “us”, “our”). By engaging our services, submitting an enquiry, or requesting a quote, you agree to be bound by these Terms. If you do not agree, please do not use our website or services.
2. Who we are
Melbourne Move Pro Pty Ltd is an Australian proprietary limited company based in Melbourne VIC, providing professional business and consulting services to individuals, small businesses and organisations. Our Australian Business Number is ABN 88 703 636 631.
3. Services
We provide advisory, planning, coordination and consulting services as described on our Services page. The specific scope, deliverables, timelines and fees for any engagement will be set out in a written quote, proposal or service agreement provided to you before work commences. Where a signed service agreement exists, its terms apply alongside these Terms; in the event of any inconsistency, the service agreement prevails to the extent of the inconsistency.
4. Quotes, fees and payment
- All quotes are prepared in Australian dollars (AUD) and are valid for the period stated in the quote, unless otherwise agreed in writing.
- Fees are payable in accordance with the payment schedule set out in your quote or service agreement. Late payments may attract interest or administrative fees as disclosed to you in advance.
- Unless expressly stated, quoted fees exclude third-party costs, government charges, and any applicable taxes. Where GST applies, it will be clearly itemised.
- We may revise pricing for future engagements; pricing changes will not apply retrospectively to confirmed engagements without your written consent.
5. Client responsibilities
To enable us to deliver services effectively, you agree to:
- Provide accurate, complete and timely information, documents and access as reasonably required;
- Respond to requests for feedback or approvals within reasonable timeframes;
- Ensure you hold all necessary rights, licences and authority over any materials or information you supply to us; and
- Comply with all applicable laws in connection with your use of our services.
Delays caused by unmet client responsibilities may affect timelines and, where applicable, may result in additional fees, which will be discussed with you before they are incurred.
6. Intellectual property
All materials, frameworks, templates, methodologies and content created or supplied by us remain our intellectual property unless expressly assigned to you in writing. Upon full payment, you receive a licence to use deliverables prepared specifically for you for your internal business purposes. Pre-existing intellectual property retained by either party remains the property of that party.
7. Confidentiality and privacy
We treat information you provide to us as confidential and will not disclose it except as required to deliver services, with your consent, or as required by law. Our handling of personal information is described in our Privacy Policy, which forms part of these Terms.
8. Australian Consumer Law
Nothing in these Terms excludes, restricts or modifies any rights you may have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other applicable consumer protection legislation. Our services come with guarantees that cannot be excluded under the Australian Consumer Law. You may be entitled to a remedy for services not rendered with due care and skill, or that are not reasonably fit for purpose, as provided by the Australian Consumer Law.
9. Limitation of liability
To the fullest extent permitted by law:
- We provide services on a professional advisory basis and do not guarantee any particular commercial, financial or operational outcome;
- Our total liability arising from any engagement is limited to the fees paid by you for the services giving rise to the claim;
- We are not liable for indirect, incidental, special or consequential loss, including loss of profits, revenue, data or business opportunity, except where such limitation is prohibited by law, including under the Australian Consumer Law.
10. Termination
Either party may terminate an engagement in accordance with the notice provisions of the applicable service agreement, or with reasonable written notice where no such provisions apply. You remain liable for fees for work performed up to the date of termination. We may suspend or terminate services immediately if you breach these Terms materially or fail to make payments when due.
